Fields of Application

General Terms and Condition (GTC) apply to all sales between S.A.R.L DE JESTHIER La Maroutie, hereinafter referred to as Château La Maroutie, registered with the Bergerac Trade and Companies Registry RCS B 382 212 397 and persons, called buyers, who wish to purchase a product listed on the website www.lamaroutie-monbazillac.com.

Any order placed with Château La Maroutie must be preceded or accompanied by validation of the general conditions of sale and unconditional acceptance.

 

The present Terms and Condition are subject to the application of French law. English and Spanish translations have been established, but in case of dispute, only the French text is valid.

Upon request, estimates and bills can be prepared in English or Spanish.

 

Château La Maroutie reserves the right to modify these terms at any time. The user undertakes to consult them regularly.

 

Products

Château La Maroutie runs its vineyard, works the fruit of its harvest, makes the production into wine, bottles it on the estate-and markets its wines directly to customers.

The wine of Château La Maroutie are sold in units of 25cl, 37.5cl, 50cl and 75cl, and are shipped in packages of 1, 2, 3, 6 and 12 bottles.

Château La Maroutie also sells Tubes of 10cl.

Stock

The products presented are valid only within the limits of available stock. In addition, information about stock inventory is for information only.

 

In case of stock shortage, a message will be sent as soon as possible, within 30 days maximum. We can either offer a wine of equivalent quality or offer you the possibility to refuse the sale and refund to you all sums paid, as a purchase order or by bank transfer, as soon as possible, and maximum within 30 days, with a delay penalty equivalent to the legal interest rate per day beyond the 30^th day.

 

Orders

 

Place an Order

It is up to buyers to browse the site and select products they wish to order by adding them to the basket by clicking on the button “Add to Cart”. Buyers can choose the quantities they want and add more products to their shopping cart by returning the website’s product pages.

Buyers must follow the different stages of the transaction: identification, choice of payment mode with the acceptance of the Terms of Use, choice of delivery method and finally, payment. An e-mail order confirmation will be sent to the e-mail address specified by the buyer and the order will be validated.

Buyer has the opportunity to follow the evolution of their orders in the section “My Account”.

 

Order Processing

Orders placed on the website www.lamaroutie-monbazillac.com will be processed within seven days after confirmation of the order, and at the latest, within 30 days.

Orders paid by credit card (Visa, Carte Bleue, MasterCard) will be charged when the order is validated.

Orders paid by check will be processed upon receipt and cashing of the check.

 

Preparation of the Order

The buyer’s order is prepared only after receipt of all sums due and after receipt of the customer information necessary to complete the contract. See paragraph Information Commissioner’s Office (CNIL).

Until such information is provided, Château La Maroutie cannot be held liable for any delays in processing or delivery of the order.

 

Château La Maroutie accepts responsibility for full performance of obligations under the contract, whether such obligations are to be executed by itself or by other service providers.

However, Chateau La Maroutie disclaims all or part of its responsibility if it is proved that the non-performance or improper performance of the contract is attributable either to the purchaser or to the unforeseeable and insurmountable occurrences by a third party unconnected with the provision of benefits under the agreement, or to a case of force majeure.

 

Money Back Guarentee

If you are not satisfied with your order, we pledge to refund or replace your order. To do this, you must return it within seven days. See below

 

Right of Retraction

The buyer has a retraction period of seven days after delivery of the order. The buyer must return the goods he does not want in their original condition in order to request an exchange or refund. Return of goods is made without penalty other than the return costs, which are the responsibility of the buyer.

If the seven days deadline expires on a Saturday, Sunday or holiday, it is extended until the next business day.

The refund will be made no later than within 30 days from the date of return of the goods to Château La Maroutie 24240 Monbazillac.

Château La Maroutie is responsible for personal information it collects in the strict framework of its business. This information is collected in order to secure the navigation of the Internet user and facilitate the management of the order or request.

On the form, fields marked with an asterisk are required. Failure to respond may result in delay in processing the request / command and adversely affect the performance of Château La Maroutie’s contractual obligation.

The buyer has a right to access and correct data about him/herself. To do this, simply contact Château La Maroutie by e-mail contact@lamaroutie-monbazillac.com.

Château La Maroutie will not disclose any confidential information to third parties other than their own partners.

Information relating to the contract are archived for a period of 10 years and can be consulted at the request of the buyer during this period.

Rates

The products are sold at the prices posted on the website the day that Château La Maroutie confirms the order. All prices are per unit, including VAT, and excluding postage, which will be billed at the rates in effect on the day of the order, and depending on the delivery option chosen by the buyer.

The price includes the ordered product, all possible offers at the time of purchase and access to the section “My Account” on the website www.lamaroutie-monbazillac.com.

Prior to payment, the buyer may request a quote by using the contact form or by e-mail contact@lamaroutie-monbazillac.com.

 

Special Offers

Our Internet offer includes a promotion. For every 100 € purchased from the website, and only from the website www.lamaroutie-monbazillac.com, a coupon of 5 € valid for your next order is given to you. (For example, for an 200 € order, 10 € is offered for your next order). This offer may be combined with other promotions on the website and is valid for one year. (For example, for an order of 250 € euros, postage is offered and a 10 € coupon is given to you). * Until October 30, 2010, delivery charges are free with a minimum order of 12 bottles for delivery to mainland France and Corsica except Maroutie WIT. Minimum order 55.20 Euro.

 

Delivery

Château La Maroutie is committed to send the order within three working days from the day the payment is validated by the Société Generale, which handles secure payments by credit card and check cashing. The order is then delivered from the winery within four days.

Château La Maroutie will not be required to deliver the goods ordered if the full price of the order is not paid.

For delivery outside mainland France, contact us.

 

If, due to incorrect information in the name and address provided by the buyer, the order is returned to Château La Maroutie, the buyer assumes all the ensuing consequences such as delays in deliveries and additional transportation costs.

 

The buyer is obligated to inform Château La Maroutie of any name and address changes, or to modify them himself on the site www.lamaroutie-monbazillac.com in the “My Account” section.

 

Signing the carrier’s delivery slip is proof that the goods were delivered in good condition. If the appearance of delivery does not seem suitable, please notify the warehouse before signing. You can also refuse the package and ask the carrier to return it. We thank you in advance for notifying us of any problems so that we can deal with the situation as quickly as possible.

 

Delivery is Carriage Free (the customer does not pay for the shipping) in metropolitan France for orders of at least 350 euros all taxes included, and for orders of at least 150 euros all taxes included near Paris and in the Paris region, up to 20km from central Paris (the reference point is Notre Dame)

Participation in delivery costs

- 1 to 5 bottles = 10 €

- 6 to 18 bottles = 20 €

- from 19 bottles = 1 Euro per bottle.

Within the limit of 250 euros the order.

 

You can choose to pick up your boxes at the next Maroutie appointment (bar, restaurant, room) in the Paris region or another region. In this case, delivery is made during appointment hours listed on the website www.lamaroutie-monbazillac.com in the News section, in the events “I love Monbazillac”.

 

Payment

Whatever the mode of payment the buyer chooses, the payment of the order will be considered final only after  the actual receipt of payment for the total amounts due.

We accept the following forms of payment:

 

- Bank Cards: CB, VISA.

Secured Payment:

Conclusion

For all disputes related to the fulfilment of these Terms and Conditions, only the Nanterre Commercial Court will have jurisdiction.

 

Tips

Your wine must be stored in a cave that is not subject to temperatures that are too high, or that has prolonged exposure to light.

Wait one or two days after delivery before tasting your wines.
